[Excerpts] The attorney for the former police officer facing the death penalty for allegedly killing his former girlfriend has filed a motion to suppress his statements to police during the investigation and any evidence seized as a result of those statements. According to the motion, filed Friday afternoon by defense attorney Kim Dowgul, investigators violated Mark Bomia’s Constitutional right to an attorney and his right not to incriminate himself during the search for his former girlfriend Anna Beach, who had been reported missing Oct. 1. One of the investigators was Detective Aaron Wilson, who was Bomia’s superior within the department... Soon after Bomia’s confession, Parker Police Chief Charles Sweatt announced Bomia’s termination, and Bomia was arrested for the murder of Anna Beach. Dowgul will address issues with the search warrant issued for Bomia’s residence in a separate motion. A hearing on the motions is scheduled for Sept. 16. Bomia’s trial has been scheduled to begin on Oct. 31. [Full article here]

    [Excerpts] The State Attorney’s Office is no longer seeking the death penalty for a former Parker Police officer [Mark Bomia] accused of killing his ex-girlfriend [Anna Beach]. Also Friday, Circuit Judge James Fensom ruled against a defense motion to suppress evidence at the trial... Several members of Beach’s family said Friday that they were upset the death penalty had been taken off the table because they believe he deserves death. The case is scheduled to go to trial on Halloween... Sheila Fulford, Beach’s sister-in-law, said she and other family members were relieved that the evidence will be heard by a jury. “He knows what he did and he needs to pay for that,” she said.
