[CA] Cop-on-cop felony stalking charges: SDPD Sgt. Davis and Officer Hayes spun a sticky web

If convicted, he faces a possible sentence of up to three years in prison. Probation is also a possibility... Both were married, admitted they had an affair and left their spouses... Judge John Einhorn said the evidence showed that the woman was “put into a state of real fear” when Davis did not heed requests from her and fellow police personnel to leave her alone. The judge said the conduct was “troubling enough” for the felony charge to stand... A Sept. 26 trial date was set...

Nine or ten San Diego officers are currently in the news accused of various crimes, to the dismay of the chief. Two of the incidents are domestic-related. I had posted on one but not the other.

San Diego police Officer Roel Tungcab is mentioned in the recent news excerpt below. The previous post on him is here:

[Excerpts] ...In late April, a judge ordered San Diego police Sgt. Kenneth H. Davis, 47, to stand trial on one count of stalking a fellow officer he had dated and three counts of making harassing telephone calls to her. Davis, a 23-year department veteran, could serve up to three years in prison if found guilty of the allegations, which came to light in February... On March 24, San Diego police Officer Roel Tungcab was arrested by sheriff's deputies in the aftermath of a fight with his wife at their Imperial Beach home. Tungcab, 39, faces misdemeanor domestic violence charges... During Friday's briefing, the SDPD spokeswoman sought to reassure San Diegans that the spate of officer misconduct cases, while troubling in nature and in number, do not reflect the overall quality of the agency's sworn and civilian personnel. SERGEANT ACCUSED OF STALKING OFFICER: Sgt. Ken Davis has been placed on paid administrative leave
NBC San Diego
By Paul Krueger
Apr 14, 2011
[Excerpts] A veteran San Diego police sergeant is accused of stalking a female officer and repeatedly harassing her with unwanted phone calls and other contact. Sgt. Ken Davis was formally charged in February with one felony and three misdemeanor charges: felony stalking and repeated harassing by phone or electronic contact. Davis pleaded not guilty, and the judge has allowed him to remain free on his own recognizance, meaning he was not required to post any bail. A police department public affairs officer confirmed Wednesday that Davis is on "paid administrative duty" and will continue to work for the department while it investigates the allegations against him... The criminal complaint alleges that Davis followed and harassed the female officer from late June until early September of last year, and harassed her by phone at least five times in early August... Judge David Szumowski issued a protective order that prohibits Davis from having any personal, phone or written contact with the alleged victim, and requires him to stay at least 100 yards away from her at all times. Davis was also ordered to surrender any firearms that he owns or has control over... Davis and the female officer had a mutual romantic relationship that went bad. This source says the victim claims Davis began harassing her, and, at one point, threatened to "kill her." According to the source, authorities moved the victim to a "safe house"... and later paid for an alarm system when the woman moved back to her own residence, because she was still worried that Davis might harm her. SDPD Sgt. Ken Davis Accused Of Stalking Fellow Officer
KGTV San Diego
April 15, 2011
[Excerpts] 10News obtained family court documents on Friday that detailed some of the troubles between a San Diego police sergeant [Ken Davis] and the female officer he is accused of stalking... Davis met the female officer in 2008. The woman is a 13-year veteran. Both were married, admitted they had an affair and left their spouses. Then, the female officer went back to her husband, which according to court documents, infuriated Davis... "He was very upset and he told me he was leaving his wife for me and if I ever left him that he would kill me," said the woman in the court transcripts... The judge began to doubt the woman's testimony after... The judge then came up with this conclusion: "I don't think he's nearly the demon you describe. I think your relationship between the two of you became so sad, unhappy, so destructive, that today's hearing was one more opportunity to drag out that relationship on some very sad and unfortunate level, but it's not grounds for a permanent restraining order. Your testimony is just way too inconsistent, ma'am. I don't think it's going to end with either of you creating harm to the other, so I'm disallowing the application for a permanent restraining order"... [Full article here]

SDPD SGT. ACCUSED OF STALKING FELLOW OFFICER TO STAND TRIAL: SDPD Sgt. Kenneth Davis Charged With 1 Count Of Stalking, 3 Counts Of Making Harassing Phone Calls
KGTV San Diego
April 27, 2011
[Excerpts] Trial was ordered Wednesday for a veteran San Diego police sergeant [Ken Davis]... Davis is accused of stalking SDPD Officer Robin Hayes, who took the stand early Tuesday morning, and prosecutors said she is in fear for her life... Hayes, a mother of two, told the court it was an on-again, off-again relationship in which Davis moved in and out of her home more than once. The relationship lasted for more than two years. Hayes testified she and Davis broke up several times. "He was very serious that he was leaving everything to be with me and he wanted me to know that was significant and … if I ever left him, he would kill me," the woman said... In the third call, Hayes said Davis told her he was outside looking at her truck. At that point, Hayes said she was scared and "worried ... that he was going to come to the front of the house, knock on the door and confront Harold. That there would be a shooting." There was no confrontation, but a dozen more phone calls and text messages followed, according to Hayes. Hayes said she soon moved to a motel for six months, living under an assumed name. Judge John Einhorn ordered Davis stand trial on the stalking charge, and advised the attorneys, "Maybe you should settle this one." In binding Davis over for trial, Einhorn said Davis wouldn't take "leave me alone" "quit it" or "it's over" and bombarded the alleged victim with text messages, phone calls and emails. "She was put into a real state of fear," Einhorn said... [Full article here]

SDPD OFFICER TO STAND TRIAL IN STALKING CASE
San Diego Union-Tribune
BY DANA LITTLEFIELD
APRIL 27, 2011
[Excerpts] A San Diego police sergeant who had a romantic relationship with a fellow officer was ordered Wednesday to stand trial on charges that he stalked and harassed the woman after their relationship ended... “I’m obsessed with you and I’m also confused,” read one of [Kenneth] Davis’ letters, according to testimony presented during a daylong preliminary hearing in San Diego Superior Court. The woman testified that he kept calling and sending text messages in August and September, telling her he loved her and was devastated about their breakup. Despite being told that she wanted nothing to do with him, Davis kept calling and texting, and on at least two occasions tried to contact her through co-workers. Eventually, she filed charges. Davis is accused of one felony count of stalking and three misdemeanor counts of making harassing phone calls. If convicted, he faces a possible sentence of up to three years in prison. Probation is also a possibility. Davis’ lawyers argued Wednesday that the felony charge should be reduced to a misdemeanor, because there was no evidence of violence or a credible threat. “The most we have here, your honor, is a heartbroken paramour who was trying to get her just to talk to him,” said attorney Ward Clay. But Judge John Einhorn said the evidence showed that the woman was “put into a state of real fear” when Davis did not heed requests from her and fellow police personnel to leave her alone. The judge said the conduct was “troubling enough” for the felony charge to stand. Still, he advised the attorneys in the case to work toward a resolution. “You all might want to settle this case,” Einhorn said... On other occasions, Davis was seen driving by the homes of her friend and her ex-husband at night, according to the testimony... [Full article here]

COPS' DIRTY LAUNDRY AIRED IN COURT: Sgt. Ken Davis has been placed on paid administrative leave
NBCSanDiego
By Paul Krueger and R. Stickney
April 27th / May 13, 2011
...[San Diego police officer Robin] Hayes detailed her relationship with the defendant, explaining how the two stopped a sexual relationship in January 2010 but kept in contact for months after, meeting for a walk, a lunch and a dinner and sharing a kiss in her home during that time. “I told him ‘I don’t want him to be confused and I don’t want to talk any more and I need to focus on my children and my job and my career,’” she testified. A few weeks later, Davis sent a letter to Hayes’ mother in which he said he was “obsessed with her,” according to testimony. Through text messages in August, Davis demanded she speak to him and accused her of wrecking his marriage, Hayes testified. It was after these text messages that Hayes said she began to fear Davis. Then on August 7, 2010, when she was working with the Mid-City Division, Hayes returned to the station between 1:15 a.m. and 1:20 a.m. to use the restroom and to fuel up at the police gas station. She said she spotted Davis, who was not scheduled to be working with that division, inside another police car fueling up at the same time. With her voice quivering, Hayes testified that she took the gun out of her holster and held it at her hip. She told the court she felt scared because she wasn’t sure what he was going to do. During a short conversation, Davis told Hayes that he had left a bag on her chair, she said. Inside the bag, she found a pair of her sandals, a pair of her underwear, a watch she had given Davis as a gift, a T-shirt she had given him as a gift and another sentimental item. She testified that she reported the incident to a co-worker immediately. In cross-examination, Davis’ attorney raised questions about whether Hayes was really scared that night. He also questioned her memory of the evening, asking her why she didn’t leave the area immediately once she spotted Davis at the gas station. Other officers were present in a show of support for the accused sergeant. A former Police Officers Association president was also in court, observing the hearing against Davis. Davis was formally charged in February with one felony and three misdemeanor charges: felony stalking and repeated harassing by phone or electronic contact... [Full article here]

ASSAULT CHARGES FOR FALLS OFFICER
Niagara Gazette
By Neale Gulley and Rick Pfeiffer
May 28, 2011
[Excerpts] A Niagara Falls police officer was arrested in the City of Tonawanda for misdemeanor assault stemming from an alleged domestic violence incident earlier this month. Henry J. Walerowicz, 40, of Niagara Falls, surrendered voluntarily after police in the City of Tonawanda issued a warrant for his arrest... “We were aware of the victim and her complaint,” Falls Police Superintendent John Chella said. “We turned the matter over to the Niagara County District Attorney’s Office and they determined it happened in Erie County.” Chella said Niagara County prosecutors contacted their Erie County counterparts and a warrant for Walerowicz’s arrest was issued. Walerowicz surrendered before reporting to work... “We have consulted with the corporation counsel and the city administrator and they are drawing up suspension papers,” Chella said. The police superintendent said Walerowicz would likely be suspended without pay for 20 working days while the criminal matter moves forward and the city prepares administrative charges against the officer. If the administrative charges are not resolved in 20 working days, Walerowicz would placed on paid administrative leave pending further hearings. “It was a domestic incident and apparently it got physical. A complaint was made. It was reviewed by detectives. Information and statements were obtained,” City of Tonawanda Police Lt. Fredric Foels said. “Police officers are held to the same standards and mores as everyone else. Because the person is a Niagara Falls police officer we called Niagara Falls police and talked to their professional standards unit. They were apprised of the situation. Within two hours yesterday (Walerowicz) surrendered at our police station,” he said. Sources tell Greater Niagara Newspapers Walerowicz had a criminal arrest around the time he was hired by the Falls Police. The incident took place in Lackawanna and the case was reportedly quickly resolved and then sealed... Walerowicz is the second Falls officer to face domestic violence charges in the last year. In December, veteran Officer Mark Feldhousen was arrested and charged with second-degree assault for an incident involving an estranged girlfriend. On May 3, a Niagara County Court jury found Feldhousen guilty of third-degree assault. He faces sentencing on that conviction in June. [Full article here]

TROOPER ORDERED TO STAY AWAY FROM EX-GIRLFRIEND
Charlotte Observer
By Michael Biesecker
Friday, May. 27, 2011

A state trooper has been assigned to desk duty after a Catawba County judge issued a domestic violence protective order requiring him to stay 100 yards away from an ex-girlfriend.

According to court records, the woman claims Senior Trooper Sean "Bobby" Lineberger stalked her in his patrol car and that he ran checks on the license plate numbers of people she spent time with.

In her court filing, [E.B.] included pages of text and Facebook messages where the trooper called her a "whore" and other derogatory names, even as she repeatedly asked to be left alone.

[E.B.] also claims Lineberger bought her drinks at a Mexican eatery where he asked her to date him again. After she declined and left in her car, [E.B.] claims Lineberger had another trooper pull her over on her way home.

Lineberger, who has worked on the patrol since 2007 and is stationed with Troop F in Hickory, could not be reached for comment Thursday.

First Sgt. Jeff Gordon, spokesman for the Highway Patrol, said an internal affairs investigation had been opened in the case and that Lineberger was placed on administrative duty on May 19. Gordon said he could not comment further, citing state employee personnel privacy restrictions.

Following a hearing on Tuesday, Special District Judge J. Keaton Fonvielle issued an order for Lineberger to stay away from [E.B.], who works at the Catawba County Justice Center in Newton. [LINK]

CLERK, TROOPER AGREE ON PROTECTION ORDER
Hickory Daily Record
Published: May 24, 2011

NEWTON -- A Catawba County clerk of court and a N.C. Highway Patrol trooper have come to an agreement regarding a domestic violence order.

According to court papers, [E.B.] and Sean Robert “Bobby” Lineberger were formerly in a dating relationship. On May 19, [E.B.] took out a domestic violence order of protection against Lineberger, saying that on May 17, Lineberger placed [E.B.] in fear of continued harassment that inflicted substantial emotional distress.

The order also states Lineberger has “committed acts of domestic violence against the plaintiff,” and “it clearly appears that there is a danger of acts of domestic violence against the plaintiff.”

The court took testimony from [E.B.] that “finds to be consistent with the allegations in plaintiff’s verified complaint,” according to the protection order. Lineberger was ordered to stay away from [E.B.], to not assault, threaten, abuse or harass her and to not threaten her family.

The domestic violence protection order was due to expire Tuesday. Although a hearing was scheduled, the two parties came to an agreement, said Al Jean Bogle, Catawba County Superior Court Clerk. Bogle said the agreement includes the following:

-They can’t come within 100 yards of each other;

-Lineberger can only come to the courthouse if his job requires it;

-Lineberger cannot run the license plates of family or friends of [E.B.] unless he is doing it as part of his job;

-Lineberger cannot email, text or mention [E.B.] in an electronic format.

Lineberger is an officer with Troop F, which serves Catawba County. He was placed on administrative duty with pay pending internal investigation, effective May 19, said 1st Sgt. Jeff Gordon, public information officer for the N.C. Highway Patrol. Gordon would not comment further on the situation.

The decision to place a trooper on administrative duty is made by the commander’s office, Gordon said.

While on administrative duty, Lineberger does not have a patrol vehicle, badge, firearm or any ID or credentials, Gordon said.

[E.B.] was not placed on any type of leave, Bogle said. [LINK]

[FL] Polk County's Deputy Robin Pagoria crossed over to the place of no return

God bless the children she hurt, and be with every soul working on this case.

It's on tape.

She'll victimize no more kids, ever.

Kudos to the investigators that are the heroes in this.

It's too toxic to tell about on my blog but I will file the articles.

Obviously there is some domestic facet of this, whether it's "custodial" or her own children.

All are in my prayers.

[UK] Court didn't believe Judge Allen's wife Melanie punched herself in the face 3 times

A judge's career was in tatters tonight - after being found guilty of battering his wife because she was late with his tea... During the case prosecutors accused both of perjuring themselves in the witness box when they had claimed that the judge hadn't been violent and that it was Melanie who had punched herself three times in the face... David Holderness, prosecuting, told the court on a previous day of the hearing that police had been called to the couple's home on February 20 last year after a 999 call had been made by an eight-year-old child at the house. On a tape played to the court the child can be heard telling the operator that Allen was “trying to kill” Mrs Allen...

JUDGE CLAIMS WIFE PUNCHED HERSELF
Telegraph.co.uk
26 May 2011
[Excerpts] James Allen QC, 62, told the court that his wife’s bruises were self-inflicted after she punched herself in the face. He claimed that, as the row continued, his wife snatched his glasses and crushed them to stop him leaving, before trying to grab the car keys from the ignition. Bradford magistrates were told that Melanie Allen was cooking the evening meal when their cleaner, Amanda Clark, arrived and wanted to speak to her. Mr Allen was unaware that Mrs Clark’s mother had just been diagnosed with cancer. He took a file from his study and went upstairs to read until he heard Mrs Clark leave the house in Wakefield 90 minutes later. “To be honest, I was irritable,” he told the court. “When I entered the kitchen I told the wife I was not very happy with Mrs Clark having visited. I had had nothing to eat all day and could not be bothered now.” He said the argument became more heated and he intended to drive away while his wife, an assistant deputy coroner, “cooled off”... My wife placed her body between myself and the kitchen door and repeated I was not leaving.” His wife then balled her fists and struck herself in the face in front of him. When he managed to reach the garage doors... one of the garage doors started to rise, it struck his wife’s leg, causing her to stumble... he was arrested and held in a police cell. He was subsequently bailed with a condition he live at his parents’ home. The row happened in February last year but in April, the judge said, he returned to live with his wife and had been there ever since... Mrs Allen, 45, told the court she had acted “pathetically” when her husband tried to leave. She claimed she hit herself in the face three times with clenched fists out of sheer frustration... [WA] Marlo and Susan lived close, died violently the same day, and both deaths were quickly said to be suicides.

Marlo Sandra Yniguez Gallagher, a police chief's wife, and Susan L. McMahon, a deputy fire marshal's ex-wife who was living with him, lived about an hour away from each other. Both died violently on December 26th, 2010. Both of their deaths were discussed publicly as likely suicides within a day. There were short blurbs in the news about both of them and then silence. How lovely they were, what their dreams or fears were, how much they were loved or how much they are missed - I don't know. I know that I think of them together and wonder if they are friends in heaven.

I wonder what is true.

I know that I won't forget their names.

MARLO SANDRA YNIGUEZ GALLAGHER

Info from the news:

Tenino Police Chief Sean Gallagher’s wife died of a shotgun blast to the head, according to Thurston County Coroner Gary Warnock. Lacey police found Marlo Gallagher, 43, dead in her home in Lacey, Washington after learning that a firearm had been discharged. Lacey police Lt. Phil Comstock said that investigators think the gunshot wound was self-inflicted. Comstock said he doesn’t know who owns the shotgun that killed Marlo Gallagher.

From Video: ...Detectives from different agencies are working on this case... Investigators are confirming a law enforcement officer lives in that house. And I checked this morning - there is a Tenino Police vehicle parked outside there. Although investigators are not telling us much more about that officer. Lacey Police say someone called them because they heard what sounded like a gunshot yesterday afternoon a little before four o'clock. Once at the house police saw a person died. They tell us they interviewed that person's spouse. Lacey Police aren't telling us the name of the person who died. They're not giving us too many details about the officer who lives there either, but they are telling us they will give us an update on this case sometime today...

"...Marlo has no one standing for her..."

SUSAN MCMAHON

Susan McMahon was found on the ground outside of a backyard shed that was fully engulfed in flames. The residence was her ex-husband's - where she had been staying with him. Her ex-husband, King County Fire and Rescue Deputy Fire Marshal Melvin McMahon was not home at the time assistance was called for. According to Mapquest, his station is 2 minutes from the home. It was that station that quickly responded to the fire.

"...The woman who died in this fire DID love her kids and grandbaby. And she was a very special person..."

Info from the news:

...Neighbors witnessed the flames engulf a backyard shed before firefighters quickly arrived at the scene... South King Fire & Rescue firefighters arrived at the house in the 29600 block of 40th Place S. within three minutes... Fire Crews don’t know what caused flames to engulf the back yard, just that gasoline inside the gardening shed may have fed the flames... “What we found were severe burns to almost 100 percent of her body,” one firefighter on the scene said... King County fire investigators continue to search for the cause of a fire that took the life of a new grandmother... The King County medical examiner has ruled the death a suicide...

From Video: "...trying to figure out what sparked a deadly fire in Auburn - a fire that hit home to responding crews who knew the 48 year old grandmother... Neignbors say they looked through the fence and saw a woman lying on the ground, on fire. Firefighters immediately recognized the house, the shed, and even the woman herself. [Deputy Chief Gordie Olson, South King County Fire & Rescue:] 'She IS an ex-wife of one of our firefighters. She was staying here at the house with him at the time. The one thing that's also difficult as a part of our family, is we knew that she was a new grandmother'... Her ex-husband was not home at the time of the fire."

Some of the March, 2011 cases I filed but didn't blog on...

Some cases I just file, and don't blog - here's some of those from March 2011.

[VA] Norfolk police Lt. William Mackenzie killed his wife Patricia and himself inside their Great Bridge residence, and left their friends and neighbors stunned because they saw no warning signs. Actually I didn't do a blog about the MacKenzie's because I was too upset about derogatory things said about the Lt. online already - people talking without KNOWING. Some bloggers make motives up - just fill in the blanks about people they don't know based on other cases. Not everyone fits into patterns. I read deeply into this incident and, for the public, this murder-suicide is a mystery. Until and unless more information is released that's all that can be intelligently (and compassionately) said. It's sad and tragic. Blessings to their people. I have all the articles and videos if family wants them in the future. Date of deaths: March 21, 2011 More here.

[ME] Fairfield Deputy Police Chief Steven Trahan - The state Attorney General's Office has decided not to prosecute Trahan on a domestic assault charge because, they say, they do not believe a judge or jury would find him guilty beyond a reasonable doubt. That stinks. (Since, he got a settlement and "resigned." There's news this month on him.) [Google him here]

[VA] Prince William County police officer Charles Edward Kincheloe has been charged with domestic assault and battery. His police powers have been suspended as part of an internal investigation. He was released on a $1,500 unsecured bond. [Google him here]

[OK] Muskogee Police Officer Perry Galvin, under investigation for allegedly hitting his wife will not be charged. “Based upon the circumstances of the case and the wishes of the complaining witness, no charges are being filed”... Galvin will remain on administrative leave until he goes before an internal board of discipline. March 2, 2011 [Google him here]

[OH] Lorain police officer Zachary Iannantuono is fired for abusing his authority in a dispute with a police dispatcher with whom he had been involved... This isn’t the first time that Iannantuono’s relationship with her has caused problems for the officer... Another officer had to remove a "defiant" Iannantuono from Nieves’ property in May 2009, and he was later placed on leave and removed from road patrol after concerns about [dangerous] comments he’d allegedly made in July 2009 came to light... [CT] Ex Wilton Police Officer Andrew Barone from Trumbull, has been sentenced to nine months in prison for one count of first-degree reckless endangerment and four counts of fourth-degree computer crime. [NY] The said murder-suicide of police officer's wife Ann Marie and baby-girl Samantha - 1989

Not Forgotten

...Officials said [Suffolk County Police Officer Robert] Williams received an outpouring of support... He was too distraught to speak with investigators yesterday... Ann Marie was said to be an upbeat person who always smiled and waved to neighbors... Ann Marie's friend of 3 years: "She was very excited about the whole house, the baby's room, everything, She was in good spirits. I've never seen her really down about anything"... Dr. Michael O'Hara, an Iowa psychiatrist and nationally recognized expert in postpartum illnesses, said it was highly unlikely someone would suffer from postpartum depression or psychosis without showing symptoms for three months and then commit such a crime...

MOTHER, DAUGHTER ARE FOUND DEAD
Sep 11, 1989

A Suffolk County police officer returned from his night shift to his Babylon home and found his wife and baby daughter dead of apparent gunshot wounds, police said early today.

Third Precinct Officer Robert Williams called police at 12:20 a.m. after returning to 7 Bradish Lane from a 4 p.m. to midnight shift, Officer David Bloom, a police spokesman, said. Williams found his wife, Ann Marie Williams, 30, and the couple's only child, 3-month-old Samantha, dead, according to Det. Lt. John Gierasch, chief of Suffolk County's homicide bureau.

Gierasch said that police had no motive or suspect. However, he did say, "The husband is not a suspect at this point." Gierasch wouldn't comment on the weapon used, the time of death or where in house the mother and daughter had been found.

Bloom said Williams had been with the force about eight years.

One neighbor, who asked not to be identified, said she hadn't heard any shots all evening. She said the Williams family had moved into the area a year or two ago and generally kept to themselves.

Police were expected to have the area blocked off all night as their investigation continues.

COP'S WIFE, BABY FOUND SHOT TO DEATH APPARENT MURDER-SUICIDE SHOCKS NEIGHBORS
Sep 12, 1989

The wife of a Suffolk County police officer apparently shot their 3-month-old daughter to death before killing herself in the basement of the family's Babylon home sometime Sunday night, investigators said yesterday.

Officer Robert Williams, an eight-year veteran of the Third Precinct patrol, returned home early yesterday after working a 4 p.m.-to-midnight shift and found his 30-year-old wife, Ann Marie, and their infant daughter, Samantha, shot to death in the basement, said Lt. John Gierasch, chief of the police homicide squad.

Williams found a handgun he owns, which he had kept in a locked box in a closet, next to the bodies. It apparently was used in the shootings, Gierasch said. No note was found, and there was no sign of any break-in or other disturbance. Williams called police at 12:20 a.m. after he found the bodies.

Police were working through the night, examining the scene and securing evidence, but said there were no clues as to what might have sparked the apparent murder-suicide. Investigators said they planned to look at the possibility that Ann Marie suffered from postpartum depression or psychosis - a psychological illness that afflicts one mother in 1,000 deliveries and, in extreme cases, can cause hallucinations and delusions. Acquaintances said, however, that she had shown no signs of depression in the past three months.

No evidence of the tragedy was visible late yesterday morning outside the Williams home, with its well-manicured lawn and hanging flower pots. A blue Ford station wagon with a baby seat in the back seat was parked in the driveway.

Officials said Williams, 30, received an outpouring of support from police officers, his parents and his wife's family. He was too distraught to speak with investigators yesterday, and relatives could not be reached for comment.

"It's a tragedy for the family, it's a tragedy for the department," Gierasch said. "Preliminary investigation has shown they were a happy couple and the birth was a welcomed event."

News of the apparent murder-suicide stunned the couple's friends, neighbors and co-workers. Ann Marie Williams was a letter carrier with the Postal Service in Bethpage for three years before taking maternity leave two weeks before giving birth to her daughter, officials said.

Friends and neighbors described Ann Marie and Robert Williams as a happily married couple who seemed thrilled with the birth of their first child. The couple knew they were having a daughter, so they designed a nursery, bought clothing and lots of toys in advance, one friend said.

Ann Marie was said to be an upbeat person who always smiled and waved to neighbors.

"They were like people you'd see living on a farm somewhere - a down-home couple," Robert Dockery, a neighbor, said.

Tom Kennish, a clerk at the Bethpage post office and a friend of Ann Marie's for the past three years, said he last saw her and Robert at a barbecue in the Williams' home two weeks ago.

"She was very excited about the whole house, the baby's room, everything," he said. "She was in good spirits." He said they had spoken often since the barbecue and she never expressed any negative feelings. "I've never seen her really down about anything."

On the quiet suburban street where the couple had lived for about two years, neighbors said they were friendly and pleasant. "Before the baby came, they were always together, jogging," said Nellie Fizzuoglio, who lives across the street. "Afterwards, he'd be jogging and she'd go out walking with the baby every day."

"They had a great marriage," one neighbor said. "She was so excited about the pregnancy . . . I find it hard to believe she would do something like this."

Dr. Michael O'Hara, an Iowa psychiatrist and nationally recognized expert in postpartum illnesses, said it was highly unlikely someone would suffer from postpartum depression or psychosis without showing symptoms for three months and then commit such a crime. "If a woman seemed to be doing pretty well and pretty happy and then she killed her baby and herself, that would be pretty shocking to me," he said.

FORMER YAKIMA COUNTY DEPUTY PLEADS GUILTY IN ASSAULT CASE

Yakima Herald Republic
By Mark Morey
Friday, March 11, 2011 AT 01:04PM
[Excerpts] A former Yakima County sheriff’s deputy pleaded guilty Friday to several felony charges that could land him in prison for more than 10 years.... Moore pleaded guilty to first- and second-degree assault on the two victims, as well as third-degree rape and residential burglary. He was originally charged with first-degree rape and first-degree burglary. The charges did not include firearm enhancements that would have added a mandatory 10 years to the sentence. Moore would have faced significantly more time if convicted as charged... Prosecutors said he held his duty pistol to the woman’s head and brandished it at the man... He was also armed when he returned later in the day and ordered the woman to perform a sex act... Moore has been in custody since his arrest; his $500,000 bail was revoked upon entry of the plea. He had been on paid administrative leave but resigned Wednesday from the sheriff’s office. [Full article here]

Action News uncovered shocking details in the police report. A woman he knew well claimed Moore held a gun to her head, punched her in the face and raped her. All while in uniform and on the clock... Shortly after Moore's arrest by Selah Police, a sheriff's sergeant, clearly stressed by the arrest of one of his own, refused back up to a Selah officer... "He was thinking about his future," said [Director of the Yakima County Jail] Ed Campbell... In fact, even the relationship Sean Moore had with fellow inmates was not consistent with a man planning to take his own life. "He was trying to be what we call the 'tank boss," Campbell said. "He was trying to control the television, trying to control the language. He didn't want Spanish spoken in the tank. And trying to exert his authority or some kind of authority, which is common with inmates. They were talked to, the issues were resolved and again that day that it happened Sean met with staff and everything seemed just fine"... [Full article here]

[CA] Dispatcher Lisa Koressel's cop husband said she killed herself while they were target practicing (1985)

Not forgetting Lisa Bernadette Koressel.

POLICE DISPATCHER DIES, APPARENTLY A SUICIDE
Los Angeles Times
Nancy Wride
March 21, 1985
A 22-year-old dispatcher for the Orange Police Department died of a gunshot wound to the head Wednesday in a remote area of Riverside County, a death the Riverside County Sheriff's Department is investigating as a suicide. The victim and her husband, a Buena Park police officer [23-year-old William Koressel], were target shooting when she died, authorities said. The victim, identified as Lisa Koressel, died almost instantly, apparently of a self-inflicted gunshot to the head, according to Riverside County Sheriff's Department investigators... Koressel reported the shooting to two passing Department of Fish and Game officers, who in turn notified the Sheriff's Department about 11:40 a.m. of a "possible report of suicide"... The couple, who married less than two years ago and were living in a Buena Park apartment, on Wednesday had gone to look at their newly purchased house, which is being built in the Riverside area, before they went "to practice target shooting," said Officer Terry Branum, Buena Park police spokesman... Friends and former co-workers expressed disbelief when told of the apparent suicide... [Riverside County Sheriff's Homicide Sgt. Steve Scully] said William Koressel told investigators that the couple had two .38-caliber revolvers with them near the lake: the husband using a two-inch-barrel gun, the wife a four-inch barrel. Lisa Koressel's gun "had been removed from the scene, from where she was," Scully said. He said "we located it in their car later." Was it significant that a police officer would move a weapon--or evidence in general--from the scene where his wife had just shot herself, Scully was asked. "You're not thinking as a police officer at that time," Scully responded. [Full article here]

Del Angel's grief from the separation became apparent to those closest to him at work and at home. But whether that actually led him to take his life will never be known... One of the last memories the family will have of him is spending Saturday night at the chief's house, watching a boxing match, Sergio said. The late chief called all of his brothers. CHIEF DEPUTY SHERIFF IS ARRESTED, RESIGNS
North Platte Telegraph
Wednesday, May 18, 2011
[EXCERPTS] Saying he could not tolerate any sort of domestic violence issues, Lincoln County Sheriff Jerome Kramer said he had no choice but to have Chief Deputy Dean Sparks placed under arrest on Tuesday. An ex-girlfriend of Sparks' filed a protection order against him and Kramer served Sparks with that protection order on Sunday morning. The ex-girlfriend alleged that she was being stalked and threatened by the now-former second-in-command at the sheriff's office. Kramer placed Sparks on administrative leave as of Monday morning, but on Tuesday at 4 p.m. Sparks was processed at the Lincoln County Jail and released after posting bond on the charge of violating that protection order... Kramer, who publicly advocates against domestic violence, said the alleged violation of the protection order left him with little choice. "Granted, Dean has not been convicted of anything, but I have always made it very clear where I stand on domestic violence issues and we have a zero tolerance on violations of the law," said Kramer. "There is a 30-year friendship involved here, but I did what I had to do"... Kramer said he asked Sparks to sign a letter of resignation and Sparks complied with the request "out of respect for the department," said Kramer ... [Full article here]

[Excerpts] REDWOOD CITY - A Hillsborough police officer is slated to be arraigned Thursday morning on charges that he barged into an ex-girlfriend's San Mateo home and shoved her several times during an argument, a prosecutor said. Martin Fritzsching, 40, is accused of letting himself into his ex's home April 13, then picking a fight with her and her new boyfriend that ended with the off-duty officer repeatedly pushing his former girlfriend, said District Attorney Steve Wagstaffe. He allegedly came back April 14 demanding the return of some jewelry he had given the woman, and she threatened to call the police. Wagstaffe said Fritzsching, a San Jose resident, replied, "You're not going to do that, because I am a cop." The woman called San Mateo police soon thereafter, and they arrested him the next day. Fritzsching, who holds the rank of police officer and has been with the department since 1996, has been placed on paid administrative leave, said Hillsborough police Lt. Caroline Serrato. "It's a personnel matter," she said. "I can't make any further comment." Fritzsching faces two counts each of domestic violence and trespassing as well as one count of child endangerment... [LA] Who killed New Orleans Police Officer Victor Gant's (abused) girlfriend Sharon Robinson and her friend Karen Iverster?

New Orleans Police Officer Victor Gant was a SUSPECT in the killings of 24 people since 1991, including his girlfriend Sharon Robinson and Sharon's friend Karen Iverster . Last I saw of him he was appealing not getting his job back.

...Dr. Peter Filozof testified at the hearing that he was a resident in the emergency room at Charity Hospital, and he examined Sharon Robinson on December 9, 1994 when she presented herself there. Dr. Filozof stated that the patient initially stated she slipped and struck her nose on the bathroom sink. However, he stated she seemed very tearful and anxious, and that the person with her (Victor Gant) seemed very overprotective of her. Dr. Filozof asked Gant to step out during the examination, and at that point, Sharon Robinson stated that she was struck by her boyfriend thirty minutes before the hospital visit. Dr. Filozof stated he included his information in this report, and that he referred her to a battered women's clinic. This information is corroborated on the discharge sheet presented to Ms. Robinson. Ms. Robinson was unable to testify at the hearing in this matter because she was killed on May 1, 1995...

OFFICER IS SUSPECT IN KILLINGS IN NEW ORLEANS
New York Times
August 13, 1995
[Excerpts] A police officer is a suspect in the killings of 24 people since 1991, including his girlfriend and several prostitutes... Seven of the victims were slain this year... Chief Richard J. Pennington of the New Orleans Police Department said that one of his officers, Victor Gant, was a suspect. The suspicion, he said, was based on the officer's relationship with two of the victims. Officer Gant's girlfriend, Sharon Robinson, 28, a casino coin changer, was one of the victims, killed on April 30 with her friend Karen Iverster, 30. Unlike most of the victims, the women were not prostitutes. Officer Gant, 33, has not been charged and remains on the force...

[Excerpts] In most cities, the specter of a police officer stalking and killing people would stir outrage. But in New Orleans - where four police officers have been charged with murder in the past year - it's just another scandal... John Reed is the attorney for the officer, whom a New Orleans television station first identified as Victor Gant. Reed said his client had nothing to do with the murders. The attorney has challenged detectives to put the officer in jail if they have a case... Authorities released a sketch of a suspect in 1992 after a woman who had been left for dead gave a description of her attacker. The drawing shows a black man in his 30s with a large, muscular build. Officer Gant is black, 33, and muscular... FBI's New Orleans office, Neil Gallagher, said that some of the earlier investigations were "not up to standard"... The officer under investigation has been questioned about a relationship with two of the victims, Sharon Robinson, 28, and Karen Ivester, 30, both of New Orleans, law enforcement officials said. Investigators found tobacco juice near one of the bodies, and the juice is being analyzed to determine whether the saliva matches that of the officer, who chews tobacco, officials said. The city has declined to release officer Gant's disciplinary records... Most neighbors said he keeps to himself. "When he was a kid, his father used to ride around with him until they could find a gang of kids," said a police official who supervises the officer and has known him for 10 years. "His father would make him get out and fight the first kid he could - just to make him tougher"...

[Excerpts] The sketch of the ""suspect" from 1992 has been reissued in connection with the current investigation. The woman who provided the description survived an abduction and attempted strangulation, giving investigators a description of a large, muscular man the FBI believes has made a habit of luring people into his car, strangling or suffocating them, then stripping and dumping their bodies... "There's no panic whatsoever,"said Tony Radosti, assistant managing director of the Metropolitan Crime Commission. ""I hate to say it, but it falls into the forgotten people, and that's what these people are," Radosti said. ""The system just forgot them"... The watershed event may have been the deaths of Sharon Robinson and a woman reported to be her friend, Karen Ivester, whose bodies were found dumped near each other on the same isolated stretch of Interstate 55 on April 30 of this year. Robinson, an employee of Harrah's Casino at the edge of the Treme district, had until recently lived with a New Orleans police officer named Victor Gant. The New Orleans Times-Picayune has reported that their relationship had been volatile, that Robinson had recently moved out of an apartment she shared with him, and that Gant was seen leaving the Harrah's Casino with her on April 29 at 2:30 a.m. Her body was found in the swamp the next day, still clad in her Harrah's uniform. Robinson had drowned. Gant has not been charged with any crime and remains on duty... Robinson's name shows up as victim No. 23 on the FBI's list. The last victim was Sandra Williams, whose body was discovered May 6 - five days after the formation of the FBI task force...

[Excerpts] ...Now, this city - battered as often by police scandals as by the hurricanes that roar ashore - has learned that a police officer was a suspect in two of the 24 killings, killings that FBI agents have said were committed by one person. The officer, Victor Gant, 33, has denied it, has remained on the job in an administrative post, and has not been charged. DNA tests are underway... This is a city where four police officers have been charged with murder in the last 18 months... [Head of the FBI's New Orleans office Neil] Gallagher said the FBI was testing DNA from Gant's blood and saliva to see if it matched evidence from the sites where the two women's bodies were found...

[Excerpts] ...On Tuesday, The Times-Picayune newspaper, quoting unidentified sources, said investigators have been unable to find evidence to tie Gant to the crimes. Gant's attorney, John Reed, says it is time for police and FBI to admit that publicly. "I think the FBI and the NOPD have some obligation to announce at this time that they do not have any concrete evidence," Reed said. "They shouldn't be permitted to declare someone a suspect" but then not admit that their case goes nowhere. "They have some obligation to say that Victor Gant has been cleared," he said... The Times-Picayune report said DNA tests of saliva found near Ivester's body proved inconclusive...

[Excerpts] A New Orleans police officer has filed a lawsuit against the police chief who a year ago named the officer as a suspect in two murders which authorities said were tied to a serial killer. The action by Victor Gant, a 17-year police veteran, comes as the Police Department is taking steps to possibly fire him. No criminal charges have been filed against the officer... Investigators said Gant had been seen leaving with Robinson from Harrah's casino, where she worked as a coin-changer, before she vanished on April 29, 1995... On Monday, Gant filed an invasion of privacy suit in state District Court claiming that Pennington named him as a suspect even though the "paucity or lack of evidence linking (Gant) to these crimes was well known by (Pennington)"... The suit was filed as the Police Department accused Gant of four alleged administrative violations that could result in his firing - charges that Gant's attorney called absurd and an attempt to run him out of the department[Excerpts] Some of the administrative violations involve Gant's romantic relationship with Robinson. Gant is accused of reporting Robinson to juvenile authorities for leaving her three children unattended, but not disclosing that he knew the woman... Another administrative charge alleges that Gant told murder investigators that he had once slapped Robinson in the mouth. Gant says he never made the statement, Welcker said. Gant also has been accused of dereliction of duty for his late arrival last year at the Police Olympics in Atlanta... Gant also is accused of carrying his police revolver after being ordered not to do so during the murder investigation... Robinson's mother, Joanne Bush, said her family is waiting for action to be taken against Gant. "We just don't understand why he hasn't been arrested," Bush said. "He was the last person to be seen with her"...

[Excerpts] A former New Orleans police officer publicly identified by his chief as a suspect in the killings of two women is trying to get his job back. Victor Gant, never charged in the slayings, was fired last year for administrative violations. During an appeal to a city civil service hearing examiner, his attorney said the violations were drummed up after the department could not link Gant to the killings. Gant, an 18-year police officer, has sued Police Supt. Richard Pennington for defamation over Pennington's public statements. After Pennington said Gant was considered a suspect in the killings of Sharon Robinson, Gant's girlfriend, and another woman, the FBI said the slayings appeared to be linked to a series of 24 killings in the southeastern Louisiana area over a number of years. The Police Department said Gant struck Robinson during a domestic incident before she was killed. Gant has denied the investigating officer's account of what he said...

[Excerpts] A New Orleans police officer is back at work, four years after being publicly identified by his chief and the FBI as a suspect in two of 24 killings investigated by a serial murders task force. The city's civil service board ordered Victor Gant reinstated after the city ran out of appeals to keep him away from the department. He returned to a desk job in the department's evidence room this week. The city is continuing to fight the order, but Gant will be on the job until a state appeal court rules... One of the departmental violations involved a simple battery complaint involving Gant's girlfriend, Sharon Robinson. Robinson and a friend, Karen Ivester, were later killed, and their cases were added to the serial killing task force's list... Eventually, the focus of the task force switched to Russell Ellwood, a former cab driver now serving a life sentence for a single killing.

APPEALS COURT UPHOLDS FIRING OF N.O. OFFICER

[Excerpts] A New Orleans police officer named publicly as a suspect in the still-unsolved killing of his girlfriend should not have been reinstated to his job, a state appeals court has ruled. The 4th Circuit Court of Appeal reversed a decision by the city's Civil Service Commission to reinstate Victor Gant to his job. The three-judge panel said other infractions, including an earlier beating of his girlfriend, were enough to justify his dismissal... Last April, the Civil Service Commission reduced his penalty to a 30-day suspension. Gant returned to work in November, assigned to administrative duties. But the court, in a decision made public Friday, said domestic violence by a police officer is enough to justify firing. "We're delighted," said attorney Ike Spears, who represented the city. "We think it's absolutely the right ruling, and we're hoping that's the end of the matter and he'll stay off the force...

[Excerpts] The city wants a fired policeman to pay back the $109,500 in back pay he was awarded in 1996. Victor Gant got the money in November after the Civil Service Commission, which had reinstated him, threatened the city with a contempt ruling. EXCERPTS FROM:
Court of Appeal of Louisiana,Fourth Circuit.
GANT v. DEPARTMENT OF POLICE
Victor GANT v. DEPARTMENT OF POLICE.
No. 99-CA-1351.
January 05, 2000

Court composed of Chief Judge ROBERT J. KLEES, Judge MIRIAM G. WALTZER and Judge DENNIS R. BAGNERIS, Sr.

Chris J. Doyle, New Orleans, Louisiana, Counsel for Plaintiff-Appellee.Ike Spears, Spears & Spears, New Orleans, Louisiana, Counsel for Defendant-Appellant. This is an appeal from a ruling of the Civil Service Commission modifying the disciplinary action taken against Victor Gant by the Appointing Authority. For the reasons stated herein, we reverse the Commission's ruling and reinstate the termination of Victor Gant's employment...

...As to the case relating to the alleged battery, the Appointing Authority has failed to prove violations of R.S. 14, Article 35 (Simple battery), NOPD Rule 2 Unauthorized Force, or Rule 2.1, Adherence to Law. In reviewing the testimony of D'Juana Robinson, its conflicts and incompleteness are apparent. The testimony also appears rehearsed. The testimony of Dr. Filoz [sic] does not appear that compelling or that he was convinced of his patient's (Sharon Robinson) mental status. The medical record states: “Management · 2) Battered Women's # given and encouraged”... Clearly there was an altercation between Appellant and Ms. Robinson. The record bears out that she sustained some type of injury, but was that the result of a domestic quarrel or an officer violating the law...

...The evidence presented at the hearing of this matter with regard to the alleged battery of Ms. Robinson consisted of the testimony of Ms. Robinson's daughter and the emergency room physician who treated Ms. Robinson on the night of December 9, 1994. D'Juana Robinson, Sharon Robinson's daughter, testified that she, her mother and her two sisters lived with Victor Gant and that her mother and Gant were girlfriend and boyfriend. D'Juana testified that on the night of December 9, 1994, she and her sisters and a friend were sleeping in the bed in her mother's apartment. She stated that she heard Gant and her mother “fussing and fighting,” and she saw Gant lock her mother in a closet. When her mother tried to get out of the closet, Gant punched a hole in the wall. She also testified that she saw Gant throw a television set on her mother, although she admitted she did not actually see the TV hit her mother. She heard her mother scream, however, and she stated her mother received stitches in her nose following this incident.

Dr. Robinson.

Ms. Robinson was unable to testify at the hearing in this matter because she was killed on May 1, 1995. Sergeant Robert Nelson testified at the hearing that he was assigned to the Public Integrity Division of the Police Department earlier in 1995. Sergeant Nelson testified that on May 1, 1995 he was assigned to assist St. John Parish detectives in their investigation of the murder of Sharon Robinson. During the course of this investigation, information was received from family members that indicated there was a domestic problem between Gant and Robinson. This investigation led to the discovery of the emergency room records from Charity Hospital indicating Ms. Robinson had been injured during an altercation with Gant. Sergeant Nelson further testified that during this investigation, Officer Gant provided a statement to him admitting that he had pushed Ms. Robinson down and she struck her head, causing her to go to the hospital. Sergeant Nelson testified that he also spoke with Ms. Robinson's daughter and other family members, and concluded that Ms. Robinson was a victim of battery at the hands of Officer Gant.

Officer Gant testified at the hearing that on December 9, 1994, he and Ms. Robinson engaged in a quarrel while in the bathroom of their apartment. He stated Ms. Robinson struck him in the mouth with the television remote control, and that he pushed her away from him. He stated she slipped and struck her head on the bathroom sink. Officer Gant testified he never struck Ms. Robinson, nor did he ever pull a gun on her and threaten to kill her...

...Officer Gant testified he never struck Ms. Robinson nor did he pull a gun on her or otherwise threaten her...

...We have carefully reviewed the entire record in this matter and conclude that the evidence overwhelmingly supports a finding that Officer Gant battered Ms. Robinson on December 9, 1994...

...Further, Ms. Robinson's daughter testified over difficult cross-examination that she observed Officer Gant and Ms. Robinson in a fight on Deember 9, 1994... We fail to find conflicts in this young girl's testimony, except insofar as the testimony conflicts with Officer Gant's version of the events. In addition, although Officer Gant attempted to claim the injury to Ms. Robinson was accidental, his credibility was seriously damaged by the testimony of D'Juana Robinson that she saw Gant strike her mother on more than one occasion. Further, the proffered testimony of Officer Riley reveals that Officer Gant pulled a gun on Ms. Robinson and threatened to kill her, both of which Officer Gant denied in his previous testimony.

In addition, the Police Department was called into an investigation of Sharon Robinson's death based Officer Gant's position there...

...Under the circumstances presented here, we find that the Commission erred in failing to credit the testimony of D'Juana Robinson and Peter Filozof...

...The act of domestic violence at the hands of a commissioned police officer under any circumstances is particularly reprehensible and obviously prejudicial to the efficient operation of the police department. We find that the battery committed on Ms. Robinson by Officer Gant, along with the other charges which were sustained by the Commission, warrants the disciplinary action of termination from employment. The Commission abused its discretion in determining otherwise...The original disciplinary action imposed by the New Orleans Police Department ordering termination of Victor Gant's employment is hereby reinstated.
