NORRISTOWN - A Chester County police officer awaiting trial for allegedly assaulting his wife during a disturbance at their Lower Pottsgrove home doesn’t want a jury to know that he is a police officer who served in the military. Tredyffrin Township Police Officer Michael J. McCarthy filed papers in Montgomery County Court on Friday asking a judge to prevent prosecutors from discussing McCarthy’s occupation, his military service, his gun ownership or his being placed on leave from the police department when McCarthy’s trial begins on Tuesday. McCarthy, through his lawyer Sean E. Cullen, maintained such evidence “is highly prejudicial and not relevant.” “The issue at hand is what occurred in the bathroom of the couples’ home at the alleged time,” Cullen maintained. Cullen also wants to prevent the jury from learning that the victim filed for a protection from abuse order against McCarthy. Any statements McCarthy gave to authorities at the time of his arrest were improperly obtained by authorities and should be prohibited as trial evidence, Cullen argued in the pretrial court document... McCarthy, 37, is charged with simple assault, harassment and disorderly conduct in connection with the alleged June 2007 assault. If convicted of all the charges McCarthy faces a possible maximum sentence of two to four years in prison... Court documents indicate Lower Pottsgrove police responded to Pottstown Memorial Medical Center about 2:10 a.m. June 26 to investigate a report that McCarthy’s wife was being treated for injuries suffered during a domestic dispute at the couple’s Lower Pottsgrove home...   2. It's pretty vile to be both an enforcer of the law and a perpetrator of it at the same time.

    I don't say that often... but it's especially offensive to the sensibilities.

    Someone who hurts their own family is not the character we expect or deserve in law enforcement.
