A former Oakland police officer will serve time in jail for a gun-related assault in Sonoma last year. A Sonoma County judge on Wednesday sentenced Christopher Del Rosario to five years of probation and nine months in jail after he pleaded guilty earlier this year to felony assault with a deadly weapon and a gun enhancement. Del Rosario, 46, will be allowed to apply for work furlough in lieu of straight jail time. Inmates on work furlough spend the night in jail and are allowed out during the day to go to work. Del Rosario was arrested in Sonoma in 2006, after witnesses said he pulled a gun on them when they saw him assaulting his girlfriend on a street. At the time, he was an 18-year veteran of the Oakland Police Department.

A former Oakland police sergeant was sentenced Wednesday in Sonoma County to nine months in jail for pulling a gun on a witness who tried to intervene in a dispute the off-duty cop was having with a woman he had been dating. Retired Sgt. Chris Del Rosario, 46, was also placed on probation for five years. He pleaded guilty in July to a felony charge of assault with a firearm and an enhancement to personally using a firearm. Instead of jail, he can apply to a work-furlough program, said Sonoma County Superior Court Judge Dean Beaupre, who imposed the sentence... In exchange for Del Rosario's plea, Sonoma County prosecutors dropped charges of battery against the woman and a second assault charge against another witness... Del Rosario retired from the department earlier this year on disability... In the Sonoma County incident, witnesses testified at a preliminary hearing last year that they were on Napa Street in the town of Sonoma on Sept. 1, 2006 when they saw a woman walking down the street alone...

...Damian Llanos of Sonoma testified that he and his girlfriend, Brittney Villeggiante, also of Sonoma, stopped behind Del Rosario's pickup when it ran up on the curb, Del Rosario jumped out and grabbed his girlfriend, who was walking on the street. Llanos said Del Rosario was choking and slapping the woman and when Llanos yelled for him to stop, Del Rosario pulled a gun out of his pants. "He pointed it right at my face, and walked directly towards me," Llanos said. "He told me I didn't see anything and to get the hell out of there." Llanos said Villeggiante, who was driving, backed up when Del Rosario started hitting the hood of the car with the butt of his gun... Deputies testified that Del Rosario denied having a gun, but a semi-automatic Glock pistol was found hidden under the hood of his truck. Sonoma County Sheriff's Deputy Sam Jones also testified that the girl friend, who was at the motel, denied that she had been abused. She did not testify Monday.

Beaupre said he would consider imposing three to five years probation and up to one year in the county jail. A misdemeanor battery charge and three felony weapons related charges are to be dismissed when Delrosario is sentenced Oct. 17...
